Jamaica Blue – Easter 2021 – Kids Colour-in Competition Terms & Conditions
  • Information about the prize and how to enter forms part of these Terms and Conditions. Participation in this Competition and acceptance of or participation in any part of the prize is deemed acceptance of these Terms and Conditions
  • The Promoter is Jamaica Blue Pty Ltd (ABN 13 059 236 387) of Unit 215F1, Building 215, The Entertainment Quarter, 122 Lang Road, Moore Park NSW 2021 PO Box 303 Double Bay NSW 1360 (website: jamaicablue.com.au).
  • The Competition starts at 9.00am (AEST) on Tuesday 30 March 2021 and ends at 5.00pm (AEST) on Tuesday 13 April 2021 (Competition Period). No entries received outside of the Competition Period will be accepted. The time of entry is the time that an entry is received by the Promoter.
  • Entry is open to all Australian residents, except the following persons who are ineligible to participate: (i) directors, officers and employees (and their immediate families) of the Promoter, of the Promoter’s related entities, or of agencies associated with this Competition, (ii) persons assisting with this Competition (and their  immediate families), (iii) Jamaica Blue franchisees (and their immediate families), and (iv) directors, officers, employees (and their immediate families) of Jamaica Blue franchisees.
  • All entrants under 18 years of age must have prior consent from their parent or guardian before entering the Competition. If the winner is under 18 years of age, the prize will be awarded to the winner’s nominated parent/guardian. The parent/guardian shall be deemed the winner for the purposes of these Terms and Conditions.
  • To enter the Competition, entrants must during the Competition Period:
    • purchase any item from the ‘Kids Menu’ at any Jamaica Blue cafe in Australia to receive an Easter Colouring Sheet;
    • colour in and write the requested personal details on the Easter Colouring Sheet.
    • lodge the completed Easter Colouring Sheet with any Jamaica Blue cafe.
  • Multiple entries are permitted. The Competition is a game of skill. Chance plays no part in determining the winner. All valid entries will be divided into separate entry groups based on the Jamaica Blue café at which an entry was lodged. All entries will be individually judged based on creativity. The best entry in each group as determined by the judges in their absolute discretion will win the prize. There will be only one (1) winner per Jamaica Blue café in Australia.
  • Judging will take place at each Jamaica Blue cafe on Sunday 18 April 2021 by the owner of that café or their representative. The judges may select additional reserve entries, which they determine to be the next best, and record them in order, in case of an invalid entry, ineligible entrant or winner not claiming the prize by the specified time. Incomplete or illegible entries will be deemed invalid.
  • The winners will be notified by telephone by 5.00pm (AEST) on Sunday 25 April 2021 using the telephone contact details provided on entry to the Competition. Each winner must claim the prize from the relevant Jamaica Blue cafe by 5.00pm (AEST) on Saturday 8 May 2021. If a winner does not claim  the prize by such time such winner will be deemed to have forfeited the prize, the winning entry will be discarded and the prize will be re-awarded to the entry judged next best. That winner  will be notified via telephone by 5.00pm (AEST) on Sunday 9 May 2021 using the telephone contact details provided on entry to the Competition and must claim the prize from the relevant Jamaica Blue cafe by 5.00pm (AEST) on Sunday 23 May 2021 or else they will also forfeit the prize.
  • All decisions by the Promoter, a café owner or their representative in connection with all aspects of the Competition are final and no correspondence will be entered into.
  • Incomplete, illegible or incorrect entries, or those which contain offensive, inappropriate, or defamatory material, or which breach any law or infringe any third party rights, will be deemed invalid. All entries become the property of the Promoter.
  • The prize is one (1) Trolls Activity Pack including 24-page Colouring Book, 24-page Puzzle pad and 6 colouring pencils at AU$6.99.
  • The total maximum value of all prizes awarded in the Competition is up to $761.91 This valuation is based on one (1) prize being awarded in respect of each Jamaica Blue café in existence at the commencement of the Competition Period.
  • The prize or any part of it cannot be transferred to a different person, exchanged for other goods and/or services or redeemed for cash. If the prize is unavailable, the Promoter in their discretion reserves the right to substitute the prize or any part of it with goods and/or services of equal value.
  • Entrants consent to the Promoter using their name, State/Territory of residence, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  • The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and/or place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this Competition. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  • Winners must comply with all conditions of use of the prize and prize supplier’s requirements. Any failure by a winner to comply with the conditions imposed by the prize supplier may result in the prize or any part of it being cancelled or withdrawn without liability to the Promoter or the prize supplier. The Promoter will not be liable if a winner is unable to use the prize of if a winner loses the prize.
  • As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  • If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in their sole discretion, to the fullest extent permitted by law to disqualify any entrant; or modify, suspend, terminate or cancel the Competition, as appropriate.
  • Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).
  • Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees (in which case that liability is limited to the greatest extent allowed by the law), the Promoter and any agencies associated with the Competition (including their respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or relating to:
    • the Competition;
    • any technical difficulties or equipment malfunction;
    • any theft, unauthorised access or third party interference;
    • any entry or prize claim that is late, lost, altered, damaged or misdirected;
    • any variation in prize value to that stated in these Terms and Conditions;
    • the delay, postponement, or cancellation of any activity;
    • any tax liability incurred by a winner or entrant; or
    • the prize or any part of the prize, including, providing, delivering, accepting, taking, participating in or using the prize or any part of the prize.
  • As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  • The Promoter collects personal information (PI) in order to conduct the Competition and may, for this purpose, disclose such PI to third parties. Entry into the Competition is conditional on providing this PI. The Promoter will also use and handle PI as set out in their Privacy Policy, which can be viewed at jamaicablue.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose entrant’s personal information to any entity outside of Australia. In providing their PI, the Entrant acknowledges that any PI is not sensitive information.

 

  • Any costs associated with entering the Competition are the responsibility of the entrant.
